In further explanation about the case you have against the Gulf Company, I wish to tell you that the court ruled that the case can not be tried this June court but wait until next autumn. … As I told you before, the law of the case was well established in your favor, which was proven by the court rejecting the Gulf Company’s demurrer some time ago. Since then, Mr. Reid has gotten a good geologist to make a report of the lease under question showing where you had lost a great sum of money by the lack of drilling on the part of Gulf. …

ORANGE DAMAGE SUIT IS HALTED. Kishi Action Seeking Two Million Is Stopped by Injunction Order. ORANGE, Texas, Feb. 15. – Trial of the case of K. Kishi vs. the Gulf Production company and the Humble Oil and Refining company, a damage suit for nearly two million dollars was halted in district court Monday on account of an injunction in federal court granted the defense to prevent further procedure in the trial.
It was stated by counsel for the defense that the injunction was granted in federal court on the grounds of a bill of discovery in equity requesting a stay in the trial, pending examination of the complaining witness, K. Kishi of near Orange, who is said to be now in Japan. It was alleged by defense attorneys that an effort had been made to procure testimony of Kishi in deposition form through the American consul general in Japan and that this could not be done because it would be in violation of the law of Japan.
The plaintiff in this case alleged damages on account of failure of the defendant companies to drill according to contract on plaintiff’s lands in the Orange oil field.
